Pa. Insurance Policy Bars Asbestos Exclusions, Jury Hears

Law360, Philadelphia (January 13, 2014, 6:57 PM EST) -- A Philadelphia jury heard arguments Monday that the exclusions relied on by Government Employees Insurance Co. and other insurers to avoid liability for tens of thousands of asbestos-related claims flew in the face of relevant Pennsylvania Insurance Department policy.

Attorneys for General Refractories Co. told the nine-member jury that the exclusions the insurers were relying on in order to avoid liability were invalid because the Insurance Department had made it a policy to reject endorsements seeking to skirt responsibility for any asbestos-related claims.
