Microsoft, Lucent Both Denied Motions In Patent Spat

Law360, New York (February 13, 2008, 12:00 AM EST) -- A federal court judge has tossed a number of allegations asserted by both Microsoft Corp. and Alcatel-Lucent in a patent dispute between the two firms over digital video signal decoding technology used in Microsoft's Windows and Xbox 360 products.

Judge Marilyn Huff sided on Tuesday with Alcatel-Lucent's contentions that Microsoft's claims over the patent were not anticipated and that it lacked a defense of license or implied license, defense of waiver, defense of exhaustion and defense of patent misuse.
