Endangered Surrogate Rule Smooths Road To Development

Law360, New York (September 9, 2013, 4:05 PM EDT) -- Federal regulators released a proposed rule last week formalizing the use of surrogates to determine the impact of development on endangered species, which experts say will speed up government decisions for oil and gas projects on federal land and lower litigation risks.

The rule would amend regulations governing Incidental Take Statements, or ITS, under the Endangered Species Act, allowing the U.S. Fish and Wildlife Service and the National Oceanic and Atmospheric Administration's National Marine Fisheries Service to look at effects on habitats, ecological conditions, and other...
