HHS Urges DC Circ. To Uphold Lower Medicare Payments

Law360, Los Angeles (September 10, 2013, 9:40 PM EDT) -- The federal government has asked the D.C. Circuit to deny rehearing to Catholic Health Initiatives-Iowa Corp. in its challenge to an Affordable Care Act provision relating to lower Medicare payments, saying Tuesday the motion to renew the case is based on a faulty premise.

The U.S. Department of Health and Human Services argued that the D.C. Circuit correctly held in June that federal regulators properly calculated so-called disproportionate share payments and didn't act in an impermissibly retroactive manner.
