Keurig Appeals Rival Cup Maker's Patent Win To Fed. Circ.

Law360, Los Angeles (September 11, 2013, 10:44 PM EDT) -- Keurig Inc. on Wednesday told the Federal Circuit its pierceable coffee cups are inventions and not resources, asking it to reverse a district judge's finding that Rogers Family Co.'s own cups didn't infringe Keurig's patents.

Keurig took exception to U.S. District Court Judge F. Dennis Saylor IV’s May ruling likening the beverage cups made by Rogers Family to the other resources necessary to make the Keurig brewers work — such as water and electricity — saying the comparison doesn’t fairly consider the cup maker’s patented inventions....
