New Judge Replaces Maynard On W.Va. High Court

Law360, New York (February 14, 2008, 12:00 AM EST) -- A retired circuit court judge has reportedly replaced the disqualified chief justice of West Virginia's highest court in connection with Massey Energy Co.'s appeal of a $220 million verdict against it.

Supreme Court Justice Brent Benjamin on Thursday appointed Frank Joliffe to replace Eliot Maynard on the West Virginia Supreme Court of Appeals, according to the Associated Press. However, Benjamin has not yet replied to a petition filed by plaintiff Wheeling-Pittsburgh Steel Corp. asking him to recuse himself.
