Ariz. Legislators Challenge Medicaid Expansion Law

Law360, Washington (September 12, 2013, 5:00 PM EDT) -- A group of Arizona legislators and citizens sued the state Thursday, alleging a planned expansion of its Medicaid program under the Affordable Care Act violates a clause in the state constitution requiring tax increases to be approved by a supermajority of state lawmakers.

The plaintiffs — 36 Republican lawmakers and 3 “concerned citizens” — allege in a complaint filed in state court that Gov. Jan Brewer had violated the constitution when she signed a bill ceding taxing authority for the planned Medicaid expansion to Thomas Betlach,...
