DOL Extends FLSA Protections To Home Health Care Workers

Law360, New York (September 17, 2013, 4:31 PM EDT) -- The U.S. Department of Labor issued a final rule on Tuesday that narrows the companionship exemption to the Fair Labor Standards Act, extending the law's minimum wage and overtime protections to in-home workers who care for the elderly, ill and disabled. 

The final regulations, which come almost two years after President Barack Obama first pledged to update the exemption in December 2011, make two major changes to the 1975 implementing rules that govern the exemption.
