Philly Firefighter Union Can't Rush City To Fill Vacancies

Law360, Philadelphia (September 18, 2013, 2:15 PM EDT) -- A Pennsylvania appeals court ruled Wednesday that the city of Philadelphia does not have to immediately fill 17 budgeted captains and lieutenants positions in the city’s fire department that union officials claim have gone vacant in violation of civil service rules.

A three-judge panel of the state’s Commonwealth Court ruled that civil service only dictated the city fill vacancies from a list of employees ranked by qualification, seniority, record of performance and job conduct and gave city officials discretion over when to fill any vacant positions....
