HHS Clarifies Pay Rules For 3rd-Party Refill Reminder Cos.

Law360, New York (September 20, 2013, 6:07 PM EDT) -- The U.S. Department of Health & Human Services, facing criticism that it is stifling business by limiting how companies may remind patients to refill their prescriptions, clarified Thursday that third parties who do the reminding may be financially compensated at “fair market value.”

Companies and industry groups had asked HHS to clarify new privacy rules, included in a January overhaul of the Health Insurance Portability and Accountability Act, mandating that patients must authorize any communications that use their personal information, including drug refills.
