Fla. Appeals Court Reverses Course On Workers' Comp Limit

Law360, Miami (September 23, 2013, 9:44 PM EDT) -- A Florida appeals court on Monday reversed its previous ruling that extended temporary disability benefits from 104 weeks to 260 weeks, saying workers who max out on the temporary benefits can immediately claim permanent ones.

The First District Court of Appeal said the state's workers' compensation law allows workers who are still totally disabled at the end of their eligibility for temporary disability benefits to immediately apply for permanent benefits because they are “deemed to be at maximum medical improvement as a matter of law,” even...
