Funeral Home Insurer Avoids Covering Wrongful Firing Suit

Law360, New York (September 24, 2013, 3:07 PM EDT) -- A Michigan federal court last week ruled a funeral home operator that embezzled millions of dollars in cemetery trust funds was not owed coverage from Federal Insurance Co. for a lawsuit claiming it improperly fired an employee who reported the wrongdoing.

U.S. District Judge Robert Cleland on Sept. 19 agreed with Federal that Mikocem LLC and its parent, Indian Nation LLC, did not preserve insurance coverage under a claims-made policy for the wrongful termination lawsuit, which plaintiff John Lemons filed about six months after Federal's policy...
