Victoria's Secret Says CIT Misclassified Bra-Shirt Hybrid

Law360, New York (September 27, 2013, 3:49 PM EDT) -- Victoria's Secret Direct LLC recently told the Federal Circuit that a lower court ruling incorrectly classified its “bra tops” for tariff purposes, saying the garment should have been labeled under a tariff category that includes brassieres and similar products.

In an appellate brief filed Sept. 23, Victoria's Secret said the U.S. Court of International Trade erroneously ruled that the bra tops should be listed under the U.S. Harmonized Tariff Schedule's heading 6114, a “nonspecific, residual, 'basket'” provision for various types of garments.
