Senate Employee's Suit Survives Dismissal Again

Law360, New York (February 19, 2008, 12:00 AM EST) -- A federal court has refused to dismiss an employment suit brought against a former U.S. senator, ruling that the complaint did not become moot when the lawmaker left office in 2007.

Judge Richard J. Leon of the U.S. District Court for the District of Columbia refused Tuesday to dismiss a suit brought against former Sen. Mark Dayton (D-Minn.), denying the senator’s claims that the allegations of his former employee, Brad Hanson, should be dismissed on the grounds of abatement and mootness.
