Court Lifts Injunction In J-Hook Patent Dispute

Law360, New York (February 20, 2008, 12:00 AM EST) -- A federal appeals court has ruled that a hook-maker has “cast enough doubt” on the validity of a patent to vacate a lower court's preliminary injunction order.

In a 2-1 decision, the U.S. Court of Appeals for the Federal Circuit ruled on Tuesday that Doc's Marketing Corp. had raised a “substantial question” regarding the validity of a patent asserted by Erico International Corp. sufficient to defeat an injunction order.
