Fed. Circ. Remands Dispenser IP Case On Obviousness Issue

Law360, San Diego (September 26, 2013, 7:30 PM EDT) -- The Federal Circuit on Thursday affirmed that two perfume packaging companies infringed a dispenser patent by competitor MeadWestvaco Corp., but found the court had erred in holding the patent and a related one were not obvious.

The three-judge panel kept in place a Virginia federal court’s finding that Rexam Beauty and Closures Inc. and Valois of America Inc. violated MeadWestvaco’s U.S. Patent Number 7,718,132 and affirmed the court’s construction of certain claims as well as its denials of indefiniteness and Rexam’s bid to exclude expert testimony....
