DFS Worker Appeals Suit Against Agency To High Court

Law360, Miami (September 27, 2013, 8:44 PM EDT) -- A former Florida Department of Financial Services employee has asked the U.S. Supreme Court to take up a suit claiming that his termination was in retaliation for his wife's discrimination suit against another state agency.

In a petition for writ of certiorari filed Sept. 17 with the Supreme Court, Byron Underwood said that the district court, and later the Eleventh Circuit, wrongly determined that he did not have standing to bring his suit because the two agencies are considered separate employers.
