Troll Bills Would Usurp Courts' Power, Fed. Circ. Judge Says

Law360, New York (September 27, 2013, 4:34 PM EDT) -- Federal Circuit Judge Kathleen O'Malley said Friday that she believed many of the bills introduced this year to address concerns about so-called patent trolls exceeded Congress's authority and would encroach on the right of judges to manage their dockets.

At a conference in Washington, D.C., sponsored by the Innovation Alliance, Judge O'Malley said she was surprised to see that the bills that have been introduced this year call for raising the pleading standards for patent complaints and setting rules for when patent cases should be stayed....
