Sierra Club Loses Bid To Stop Strip Mining In Fla. Wetlands

Law360, Los Angeles (September 30, 2013, 9:52 PM EDT) -- A group of environmentalists led by the Sierra Club on Monday lost a bid to fight a permit for strip mining in Florida wetlands when a Florida federal judge deferred to the decision-making power of the U.S. Army Corps of Engineers.

U.S. District Judge Henry Lee Adams Jr. found that the environmental groups hadn’t sufficiently proven the agency had done anything legally wrong when it chose not to hold a public hearing, and that the court should defer to the agency’s decision making in such cases....
