Dutch Appellate Court Upholds Lipitor Patent

Law360, New York (February 21, 2008, 12:00 AM EST) -- An appellate court in the Netherlands has upheld a patent covering a key component of Pfizer Inc.’s blockbuster cholesterol drug Lipitor, the pharmaceutical company said Thursday.

The decision by the Court of Appeal of The Hague in the Netherlands will delay the launch of a generic version of Lipitor by Indian generic maker Ranbaxy Laboratories Ltd. until Pfizer’s patent expires in November 2011.

Pfizer said the patent, EP 247,633, is a basic patent covering atorvastatin, the active ingredient in Lipitor.
