Siding With Swatch, TTAB Refuses Trademark For 'IWatch'

Law360, New York (October 2, 2013, 5:58 PM EDT) -- A federal trademark appeals board ruled Monday that watchmaker M.Z. Berger & Co. couldn't register a trademark for “IWATCH” because it didn't have any real plans to use it, siding with objections from Swiss watch giant Swatch Group Ltd.

MZB lacked “bona fide intent” to use the mark in commerce and was instead merely trying to reserve the mark in case it later decided to do so, the Trademark Trial and Appeal Board said in a precedential opinion.
