11th Circ. To Hear Fla. Medical Malpractice Law Case
Law360, Miami (October 3, 2013, 10:38 PM EDT) -- A fight over Florida's medical malpractice law enacted earlier this year is headed to the Eleventh Circuit, as the defense filed Monday for an appeal of last week's district court ruling that the law violates federal protections of patient medical information.
One of five lawsuits filed July 1 in federal and state courts in Florida as part of a strategy coordinated by the Florida Justice Association, the current case, Murphy v. Dulay, has pitted the trial lawyers' group against the Florida Medical Association, which lobbied hard for the legislation, saying it corrected “glaring imbalances in the state's tort system.”
