FAA Skimped On Cape Wind Risk Analysis, DC Circ. Told

Law360, Washington (October 8, 2013, 3:12 PM EDT) -- The Federal Aviation Administration never fully analyzed the risks of the first U.S. offshore wind farm to local aviation when it signed off on the Nantucket Sound project, the town of Barnstable, Mass., told the D.C. Circuit on Tuesday.

Instead of following through with a complete analysis of the issues the 130-turbine Cape Wind project could create for local aviation, Barnstable maintained FAA shirked its statutory duties and approved the wind farm, ignoring a prior D.C. Circuit order to conduct a more thorough review.
