Farm Groups Appeal EPA Win On Chesapeake Pollution Limits

Law360, Chicago (October 8, 2013, 5:54 PM EDT) -- Several agriculture groups on Monday appealed to the Third Circuit a recent decision upholding a set of federal pollution restrictions for the Chesapeake Bay watershed, with one group calling the rules a “power grab” by the U.S. Environmental Protection Agency.

Led by the American Farm Bureau Federation, the groups are challenging U.S. District Judge Sylvia H. Rambo’s ruling last month in favor of the EPA on its 2010 program that set daily limits on the amount of nitrogen, phosphorous and sediment allowed into the bay, according...
