Bard Berated For Fee Demand In Dropped Vaginal Mesh Suit

Law360, New York (October 11, 2013, 4:52 PM EDT) -- A woman who sued C.R. Bard Inc. over an allegedly defective vaginal mesh implant insisted Friday that she does not owe the company attorneys' fees for dropping her suit weeks before trial, saying her dismissal was no different than a settlement.

Bard is demanding fees from plaintiff Linda Rizzo and her husband, Ronald, saying it wasted significant time and money preparing for a trial in a suit she dismissed without explanation on Sept. 20.
