ITC Nixed LG Patent Probe On Faulty Basis, Fed. Circ. Hears

Law360, New York (October 11, 2013, 7:47 PM EDT) -- Taiwanese developer Industrial Technology Research Institute told the Federal Circuit on Thursday that the U.S. International Trade Commission relied on erroneous claim construction to decide that LG Electronics Inc. had not infringed on ITRI's patent for backlighting technology used in liquid crystal displays.

In an exhaustive 121-page brief, ITRI urged the panel to declare that the ITC adopted a faulty interpretation of a critical portion of the patent claims and to remand the case back to ITC for reconsideration.
