Motorola Asks Fed. Circ. To Reverse ITC Ruling In Apple Row

Law360, New York (October 11, 2013, 5:42 PM EDT) -- Motorola Mobility Holdings Inc. urged the Federal Circuit on Friday to reverse a U.S. International Trade Commission ruling that Apple had not infringed one of its smartphone patents, saying Apple's devices practice the asserted claims.

Motorola Mobility counsel Edward J. DeFranco told a three-judge panel Friday that the commission erred by finding that the accused iPhones and iPads were not capable of meeting the limitations of Motorola's asserted data patent.

“This case is pretty unique,” he said. “The law cannot be more strongly in our favor.”...
