Customs Misclassifies Chinese Dinnerware Imports, Suit Says

Law360, Washington (October 15, 2013, 4:49 PM EDT) -- World Kitchen LLC filed suit in the U.S. Court of International Trade on Friday, alleging the U.S. Customs and Border Protection repeatedly misclassified its Chinese dinnerware and bakeware imports under the tariff schedule.

In its CIT complaint, World Kitchen claimed Customs has charged a 9.8 percent duty rate on its "French White" pattern dinnerware, bakeware and serveware that it purchased from Sun World Commerce Co. Ltd. and imported into the U.S. since 2002. However, the appropriate tariff rate should be 4.5 percent, the complaint alleged....
