Top Canada Court Broadens Environmental Reporting Duty

Law360, New York (October 18, 2013, 5:26 PM EDT) -- The Supreme Court of Canada ruled Thursday that a highway project contractor was obligated to confess to Ontario environmental authorities it blasted flying rocks into a family's home, saying its reporting duty was triggered even in the absence of known environmental damage.

The appeals court denied Castonguay Blasting Ltd.'s argument that injury or damage to private property alone is insufficient to engage the Ontario Environmental Protection Act's requirement that companies report the discharge of contaminants to the provincial Ministry of the Environment.
