Ruling On Bid To Dismiss ACA Subsidy Suit Expected Tuesday

Law360, Washington (October 21, 2013, 4:44 PM EDT) -- A Washington, D.C., federal judge will decide Tuesday whether to nix a suit by small-business owners and individuals alleging that an Internal Revenue Service rule unlawfully expands Affordable Care Act insurance subsidies and penalties.

U.S. District Judge Paul L. Friedman said at a hearing Monday that he will issue an oral ruling today on the government's motion to dismiss, which claims the plaintiffs lack standing to bring the suit.
