Dow Chemical Prevails In Canola Patent Challenge

Law360, New York (December 22, 2005, 12:00 AM EST) -- Cargill Inc.’s patent challenge against Dow Chemical Co. deflated once again in federal court after a jury found Cargill had withheld information from the U.S. Patent and Trademark Office.

Cargill sued the company’s subsidiary, Dow AgroSciences LLC, and its customer, Canbra Foods Ltd., in September 2003 in the U.S. District Court for the District of Oregon. They were accused of infringing four Cargill patents for high stability canola oil with Dow's new Natreon product.
