N.C. Pollution Claims Will Move Forward

Law360, New York (February 28, 2008, 12:00 AM EST) -- A federal judge has denied the Tennessee Valley Authority’s motion for summary judgment in a suit with the state of North Carolina over air pollution from the utility’s power plants.

In an order signed Tuesday, U.S. District Court Judge Lacy Thornburg found that North Carolina had provided sufficient evidence to move forward with its claims that emissions from the utility’s coal-fired power plants harmed the state’s health and environmental quality.
