Law360, New York (October 31, 2013, 5:45 PM EDT) -- On Sept. 28, 2012, the United States District Court for the District of Columbia vacated and remanded, with the exception of an increase to the position limits for nine agricultural and soft commodities, a final rule adopted by the Commodity Futures Trading Commission, which established federal position limits for futures, options and swaps on certain agriculture, metal and energy commodities. While the CFTC interpreted the Dodd-Frank Wall Street Reform and Consumer Protection Act to mandate the commission to establish federal position limits without any finding of necessity or appropriateness, the district court disagreed....
