NC Dental Board Asks High Court To Review FTC Challenge

Law360, Washington (November 1, 2013, 4:01 PM EDT) -- The North Carolina State Board of Dental Examiners has asked the U.S. Supreme Court to review a Fourth Circuit finding that said it didn't qualify for immunity from a Federal Trade Commission crackdown on the board's efforts to block nondentists from offering teeth-whitening services.

The dental board told the high court in an Oct. 25 petition for writ of certiorari that the Fourth Circuit ran afoul of decades of antitrust law in its decision allowing the FTC's to police their teeth-whitening policies.
