Bush Administration Won't Appeal Medicaid Order

Law360 (February 28, 2008, 12:00 AM EST) -- The Bush administration has decided not to appeal an injunction order that blocked its proposed cuts to Medicaid generic drug reimbursement, according to one of the plaintiffs in the case.

The National Community Pharmacists Association, which represents independent community pharmacies, said the government had until Feb. 19 to appeal the order, but that it chose not to do so.

The case will now proceed on the merits, starting with an administrative record that the government must produce about how it fashioned the rule in question....
