5th Circuit Revives Pollution Suit Against BP

Law360, New York (February 28, 2008, 12:00 AM EST) -- A federal appeals court has determined that BP Products North America Inc. should not have been let off the hook from a lawsuit seeking damages for contamination of property in New Orleans that BP had once leased.

The U.S. Court of Appeals for the Fifth Circuit reversed a district court’s grant of summary judgment to BP on Thursday, reviving Langhoff Properties LLC’s allegations that the oil company was responsible for dumping petroleum and other toxic substances that polluted the soil and groundwater.
