Allergan Triumphs In 'Botox' Trademark Dispute

Law360, New York (November 5, 2013, 6:27 PM EST) -- The Trademark Trial and Appeals Board has found that Allergan Inc.'s “Botox” name is a famous trademark and that another company couldn't register the word “Botulex” for marketing a no-injection alternative to the cosmetic treatment.

The TTAB said Allergan had spent more than $10 billion in advertising the name over the past 14 years and that within the target demographic — high-income women between ages 30 and 60 — a whopping 95 percent knew what Botox was.
