10th Circ. Says No Fraud In Flotek Contract Dispute

Law360, Los Angeles (November 5, 2013, 8:23 PM EST) -- The 10th Circuit affirmed the dismissal of fraud and conspiracy claims against Chemical & Equipment Specialties Inc., parent company Flotek Industries Inc. and its top executives, finding on Tuesday they didn’t defraud a Norwegian energy company with which they had a distribution agreement.

Plaintiffs Bjorn Myklatun and Oil Innovation AS sued CESI, Flotek, Flotek President Todd Sanner and former Flotek CEO Jerry Dumas in 2009 for tortious interference, fraud and civil conspiracy, alleging they had signed an unlawful agreement with Halliburton Energy Services Inc. The claims...
