CEO Sues To Escape CPSC's $57M Buckyballs Recall Suit

Law360, New York (November 12, 2013, 5:15 PM EST) -- The former CEO of Buckyballs maker Maxfield & Oberton LLC launched a federal lawsuit Tuesday alleging the U.S. Consumer Product Safety Commission overstepped its jurisdiction by targeting him personally for the $57 million recall his company refused to conduct.

Craig Zucker says he is neither a product manufacturer nor a distributor subject to the CPSC’s statutory authority and can’t be party to an administrative suit the agency launched last year over Maxfield’s refusal to stop selling the allegedly defective desk toys.
