Gov't Ducks State Dept. Employee's Discrimination Suit

Law360, Los Angeles (November 14, 2013, 6:42 PM EST) -- A Federal Claims Court judge on Thursday granted the government’s bid to toss a suit filed by a former State Department employee who says he was discriminated against at work, siding with the government’s claim that the court didn’t have subject matter jurisdiction.

Judge Edward J. Damich granted the motion to dismiss on the grounds that the mediation agreement Richard Higbie entered into when he first embarked on his discrimination dispute didn’t claim any money damages, and found that those damages are not implied.
