Steve Madden Urges TTAB To Grant 'Freebird' Mark

Law360, Washington (November 21, 2013, 6:18 PM EST) -- Shoemaker Steve Madden Ltd. on Thursday urged the Trademark Trial and Appeals Board to overturn the denial of its application for the “Freebird by Steven” trademark, arguing its requested mark was distinctive enough from a similar existing mark to be granted.

Steven Madden counsel Thomas Furth of Kudman Trachten Aloe LLP acknowledged that there was “not a huge difference” between its requested mark and an existing “Free Bird” mark trademark for clothing held by manufacturer Damo Clothing Inc.
