Travelers Says Claims Not Time-Barred In $47M Pfizer Suit

Law360, New York (November 26, 2013, 1:46 PM EST) -- Travelers Indemnity Co. on Monday asked a federal judge not to toss its $47 million lawsuit claiming it overpaid Pfizer Inc. for the epilepsy drug Neurontin due to the drugmaker’s anti-competitive efforts and aggressive marketing of off-label uses, saying its claims are not time-barred.

Travelers, the St. Paul Fire and Marine Insurance Co., and the Standard Fire Insurance Co. alleged in their July 2012 complaint that because of Pfizer’s deceptive marketing to physicians, the insurers have overpaid millions in connection with workers’ compensation claims stemming from...
