Altivity, Graphic Must Divest Mills In $1.75B Deal

Law360, New York (March 5, 2008, 12:00 AM EST) -- The U.S. Department of Justice approved a $1.75 billion merger between Altivity Packaging LLC and Graphic Packaging International Inc. on Wednesday on the condition that the new company divest two paperboard mills.

The DOJ said that the original merger would have discouraged competition in the market for coated recycled boxboard, the kind of paperboard used to make cereal boxes, among other packaging.

Together, Altivity, currently the largest CRB producer in the U.S., and Graphic, the fourth largest, would have claimed about 42% of the CRB market....
