Speaker Startup Grain Audio Can't Register Name, TTAB Says

Law360, New York (November 26, 2013, 6:53 PM EST) -- A federal trademark appeals panel refused a registration last week on the name of audio equipment startup Grain Audio, affirming an examiner's ruling that it was too close to the already registered “EGRAIN.”

The company — a Kickstarter-founded New York City enterprise that makes speakers and headphones largely composed of wood — wanted to register its name as a trademark for selling various audio equipment, but the Trademark Trial and Appeal Board refused the registration on the grounds of likelihood of confusion.
