Water-Rights Transfer Allowed For $18B Utah Nuke Project

Law360, Los Angeles (December 2, 2013, 7:42 PM EST) -- Nuclear power developer Blue Castle Holdings Inc. won its bid to keep the rights to take water from Utah’s Green River for a proposed $18 billion plant, with a Utah judge ruling Wednesday that the state engineer had properly approved the company’s application for appropriation of water.

Judge George M. Harmond found that Utah had water to spare in its allotment from a series of interstate agreements on sharing the supply from the Colorado River, according to Wednesday’s decision.
