German Antitrust Agency Outlines Limits Of M&A Controls

Law360, New York (December 5, 2013, 7:00 PM EST) -- The German federal cartel office on Thursday published a draft of a new guidance document to help foreign companies more easily determine whether proposed mergers “significantly affect” the German market and therefore subject to German M&A control rules. 

Many foreign companies currently face considerable difficulty when navigating the German bureaucratic landscape, which requires a proposed cross-border merger to be declared in Germany if it is considered to have a “domestic effect” as stipulated by German antitrust law, according to the Bundeskartellamt.
