IPhone Case Maker Asks Fed. Circ. To Reverse ITC Ruling

Law360, Washington (December 5, 2013, 7:20 PM EST) -- Griffin Technology Inc. urged the Federal Circuit on Thursday to reverse a U.S. International Trade Commission decision finding its protective cases for several Apple Inc. devices infringed an Otter Products LLC patent, claiming the commission misconstrued a key patent term.

Although Griffin never objected to an ITC administrative law judge's definition of the term “groove” in Otter's patent, the company told a three-judge panel that the commission erroneously broadened that definition in order to find that its Survivor case for the iPod Touch infringed the patent-in-suit....
