Judge Tosses Liability Claim In Lawnmower Fire Suit

Law360, New York (March 7, 2008, 12:00 AM EST) -- A judge has dismissed a claim in an insurance company lawsuit alleging that a pre-owned Sears Roebuck & Co. lawnmower started a fire at a Delaware couple's property in 2006.

On Wednesday, Judge Joseph Farnan Jr. of the U.S. District Court for the District of Delaware dismissed a count alleging strict liability in the suit brought by Nationwide Mutual Fire Insurance Co.
