Pa. Pushes For 3rd Circ. Hearing In Gay Marriage Dispute

Law360, New York (December 11, 2013, 3:23 PM EST) -- Pennsylvania officials defending the state's gay marriage ban from a constitutional challenge asked a federal court Tuesday to ignore their opponents' jurisdiction arguments and allow an interlocutory appeal to the Third Circuit for review of whether the plaintiffs' claims fall under federal jurisdiction.

The Pennsylvania secretary of health and other state officials say that if the federal court grants an appeal, the Third Circuit will find that the 1972 U.S. Supreme Court decision in Baker v. Nelson requires the dismissal of Deb Whitewood's suit. They say...
