Quinn Emanuel Can't Shake Contract Atty's OT Action
By Richard Vanderford (December 11, 2013, 6:25 PM EST) -- A New York federal judge said Wednesday that she would not toss a putative class action a lawyer brought over Quinn Emanuel Urquhart & Sullivan LLP's alleged failure to pay overtime to temp attorneys, ruling that the lawyer might be entitled to extra pay.
U.S. District Judge Ronnie Abrams said it was not clear that William Henig, a contracted lawyer, was exempt from overtime as Quinn Emanuel had contended. Under federal law attorneys practicing law are normally considered professionals not entitled to overtime pay, and the firm argued that the case should be dismissed.
